What is Summary Administration?

Summary Administration is a streamlined version of Florida probate. It doesn’t require appointing a personal representative and can often be completed in just 1 to 3 months.

It’s available when:

  • The total value of the estate is $75,000 or less, not including exempt property (like a Florida homestead); or
  • The person died more than 2 years ago, regardless of asset value.

If eligible, Summary Administration allows you to avoid many of the formalities of full probate — saving time, money, and stress.

Do You Qualify for Summary Administration?

You may qualify if:

  • The deceased had no debts or debts that are legally barred
  • The estate’s value is under $75,000 (not counting the home or certain personal property)
  • There’s no need for a personal representative (e.g., no lawsuits or real estate sales requiring one)
  • All heirs agree on what should happen
  • It’s been over 2 years since death
