Do You Need to Open Probate in Florida?

You probably need probate if:

  • The person who passed away owned assets in their name only (like a home or account without a joint owner)
  • There’s no trust or transfer-on-death designation
  • The estate is worth more than $1,000
  • You need legal authority to act (such as selling property)
