Distribution without Administration in Florida
Not ALL Estates Require Probate
In some limited situations, Florida allows assets to be transferred without going through full probate. This is called Distribution Without Administration, and it applies only in very narrow cases.


What is Distribution Without Administration?
Distribution Without Administration is a shortcut process available when:
- The decedent did not own real estate
- There are no significant assets
- The only property left is:
- Exempt personal property (up to $20,000 in value, like furniture or appliances), or
- Refundable expenses, like prepaid funeral costs, or
- bank accounts under $1,000
The Distribution without Administration paperwork is filed directly with the probate court but doesn’t require a full probate case or attorney. You can usually get the required paperwork from the local Clerk of Court’s office.
